Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PackNinja iOS application (the "Service") provided by Vince Chiang ("we," "us," or "our"). Please read these Terms carefully before using our Service.

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

Description of Service

PackNinja is an iOS application designed to help users create, manage, and organize packing lists for trips. The Service includes core features available for free, as well as premium features available via subscription. Features include reusable item catalogs, trip-specific lists, category management, smart suggestions (including AI-powered suggestions, weather information, and adapter information), list sharing, and other utilities related to trip planning and packing.

Use of the Service

You agree to use the Service only for its intended purposes and in accordance with all applicable laws and regulations. You are responsible for your conduct and your content within the Service.

• You are responsible for the accuracy and completeness of the information you input into the Service (e.g., trip details, items to pack).
• You agree not to misuse the Service, including its backend features (such as sharing or AI suggestions) by, for example, attempting to disrupt them, sending an excessive number of requests, or using them for unintended purposes.
• You acknowledge that final decisions about what to pack and any consequences thereof are solely your responsibility.

Subscriptions and Fees

The Service is provided on a freemium basis. You may use the core features of PackNinja free of charge. Access to certain enhanced or premium features requires an active, auto-renewing subscription.

• Subscription Plans and Lifetime Purchase: We offer monthly subscription ($2.99/month), yearly subscription ($19.99/year), and a one-time lifetime purchase ($49.99). Pricing is based on U.S. Dollars (USD). For other regions, the actual price may vary and will be converted to your local currency. The final price, including any applicable local taxes, will be displayed to you on the App Store's payment screen before you confirm your purchase. Prices are subject to change, and we will aim to provide you with notice of any fee changes.
• Billing and Payments: All payments are processed through the Apple App Store and are subject to the App Store's terms and conditions. Subscription plans (monthly and yearly) will automatically renew at the end of each subscription period unless you cancel them through your Apple ID account settings at least 24 hours before the end of the current period. The lifetime purchase is a one-time payment that does not renew.
• Free Trials: We may offer a free trial for our subscriptions. The free trial provides access to the subscription features for a limited period. At the end of the trial period, you will be automatically billed for the subscription plan you selected unless you cancel at least 24 hours before the trial ends. You can manage or cancel your free trial through your Apple ID account settings.
• Cancellations and Refunds: You are responsible for managing your subscriptions. If you wish to cancel, you must do so via your device's App Store settings. All refund requests are handled by Apple and are subject to Apple's policies.

Intellectual Property Rights

• Our Intellectual Property: The Service and its original content (excluding content provided by you), visual design, user interface, features, functionality, and the PackNinja name and logo are and will remain the exclusive property of Vince Chiang. The Service is protected by copyright, trademark, and other laws.
• Your Content: You retain all ownership rights to the content you create ("User Content"). You grant us a limited license to use your User Content solely to the extent necessary to provide and improve the Service (e.g., storing it on your device/iCloud, processing it for sharing or AI features at your request).
• Third-Party Content and Services: Features like weather forecasts, AI-powered suggestions (utilizing services like Google Gemini), and other third-party materials are provided for your convenience. Your use of these features may be subject to third-party terms.

Smart Features, Suggestions, and Disclaimers

No Warranty

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability

IN NO EVENT SHALL VINCE CHIANG BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM YOUR USE OF THE SERVICE OR ANY CONTENT OBTAINED FROM THE SERVICE.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. All provisions which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability. You may terminate these Terms at any time by deleting the application from your device.

Governing Law

These Terms shall be governed by the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

Changes to Terms of Service

We reserve the right to modify these Terms at any time. If a revision is material, we will aim to provide at least 30 days' notice. By continuing to use the Service after revisions become effective, you agree to be bound by the revised terms.
